Chief and Council

 

Chief and Council are responsible to sanction Honouring our Children, Families and Nation Act by passing Band Council Resolution at a duly convened meeting of the council. Chief and Council are the governing body with the inherent right to self-determination as exercised and recognized by the United Nations Declaration on the Rights of Indigenous Peoples and section 35 of the Constitution Act, 1982 to include the jurisdiction related to Child and Family Services as well as legislative authority for these services and authority to administer and enforce this Act.

 

Chief and Council appoint two (2) levels of governance that include: Board of Directors and the Elders Council.

 

Chief and Council's Legislative Authority and Coordination Agreement pursuant to section 10.1 of the Act, has the inherent and legislative authority to create, amend and enact this Act and any regulations required:

(i) the provision of emergency services to ensure the safety, security and well-being of children; (ii) support measures to enable children to exercise their rights effectively;

(iii) fiscal arrangements, relating to the provision of Child and Family Services, that are sustainable, predictable, needs-based and consistent with the principles of substantive equality in order to secure long-term positive outcomes for Peguis children, families and the First Nation, and to support the capacity of the Peguis First nation to exercise its legislative authority with maximum effectiveness; and

(iv) Any other coordination measure related to the effective exercise of the Peguis First Nation legislative authority.
